{"id":3505,"date":"2009-03-30T07:43:41","date_gmt":"2009-03-30T12:43:41","guid":{"rendered":"http:\/\/anglicansamizdat.wordpress.com\/?p=3505"},"modified":"2009-03-30T07:43:41","modified_gmt":"2009-03-30T12:43:41","slug":"the-stepford-diocese","status":"publish","type":"post","link":"https:\/\/www.anglicansamizdat.net\/wordpress\/the-stepford-diocese\/","title":{"rendered":"The Stepford diocese"},"content":{"rendered":"<p>In the latest synod of the Diocese of Niagara, the diocese&#8217;s dealings with ANiC parishes &#8211; which have taken place mainly in the courts &#8211; were <a href=\"http:\/\/www.niagara.anglican.ca\/synod2008\/synod_second_session.cfm\" target=\"_blank\">enumerated<\/a> for the benefit of the synod delegates:<\/p>\n<ul type=\"disc\">\n<li>Litigation with ANC &#8211; these      comments are on public record<\/li>\n<li>Feb 08 &#8211; 3 congregations      withdrew<\/li>\n<li>Preliminary Court hearings      took place in Feb and then in March 08<\/li>\n<li>She ruled on the sharing the      buildings by D of N and ANC &#8211; costs to be paid by withdrawing      congregations.\u00a0 Application for appeal was denied and costs were      awarded.\u00a0 The wardens of the withdrawing congregations are the      defendants<\/li>\n<li>St. Peter&#8217;s later passed a      motion to withdraw in June of 08<\/li>\n<li>Costs have been adjudicated      in one case &#8211; in favour of the diocese 20,000.\u00a0 This has been      paid.\u00a0 Our request was for 180,000.\u00a0 The justice was looking at      whether these costs are to be assumed personally by the wardens.\u00a0 We      do not have a decision yet from the judge.<\/li>\n<li>There is a provision if      there is a difficulty in the interim arrangements &#8211; this can go before an      arbitrator.\u00a0 We have given a list of things that need to go before      the arbitrator.<\/li>\n<li>The network lawyer has an      application to move the court case from Hamilton to Milton.\u00a0 This      application is to be heard on Apr 5.\u00a0 We oppose this.<\/li>\n<li>There is a case in the      Diocese of New Westminster.\u00a0 In our case we applied for our right to      hold these parishes.\u00a0 In their case the network are plaintiff and the      diocese is the defendant.\u00a0 That matter is to be heard in May.<\/li>\n<li>We continue to work with the      people of St. Peter&#8217;s to bring them into the main body of the litigation.<\/li>\n<li>If we get a decision on      costs in a reasonable period of time &#8211; there would be a possibility that      we will be in court in the fall of 2009 &#8211; on the main action.\u00a0 That      is optimistic.<\/li>\n<li>Everything in this report is      on public record.<\/li>\n<li>No questions<\/li>\n<\/ul>\n<p>There is nothing much new in this; the unnerving part is that there were no questions.
