{"id":19210,"date":"2013-04-21T14:43:19","date_gmt":"2013-04-21T18:43:19","guid":{"rendered":"https:\/\/anglicansamizdat.net\/wordpress\/?p=19210"},"modified":"2013-04-21T14:43:19","modified_gmt":"2013-04-21T18:43:19","slug":"bishop-michael-bird-is-suing-me","status":"publish","type":"post","link":"https:\/\/www.anglicansamizdat.net\/wordpress\/bishop-michael-bird-is-suing-me\/","title":{"rendered":"Bishop Michael Bird is suing me"},"content":{"rendered":"<p>On February 19<sup>th<\/sup> 2008, the Diocese of Niagara served St. Hilda\u2019s with legal papers with the intention of taking possession of St. Hilda\u2019s building and freezing our bank account.<\/p>\n<p>On February 19<sup>th<\/sup> 2013, exactly five years later, I was served personally with a statement of claim for defamation of character from the Diocese of Niagara\u2019s Bishop Michael Bird.<\/p>\n<p>The claim is seeking:<\/p>\n<ul>\n<li>$400,000 in damages plus court costs and their legal costs.<\/li>\n<li>An interim and permanent injunction to shut down Anglican Samizdat.<\/li>\n<li>An interim and permanent injunction prohibiting me from publishing further comments about Michael Bird.<\/li>\n<\/ul>\n<p>The claim quotes \u2013 with sporadic accuracy &#8211; 31 blog postings that are alleged to be libellous. On the advice of my lawyer, the posts were removed the day after receiving the statement of claim.<\/p>\n<p>Contrary to what one might expect in such circumstances, I did not receive a <i>cease and desist<\/i> letter in advance of the suit.<\/p>\n<p>Initial negotiations for an early settlement have been unsuccessful.<\/p>\n<p>I have filed a statement of defence, the pleadings are now closed and we have commenced the Discovery process.<\/p>\n<p>Stay tuned.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On February 19th 2008, the Diocese of Niagara served St. Hilda\u2019s with legal papers with the intention of taking possession of St. Hilda\u2019s building and freezing our bank account.
